It is a sad fact that all of us will die and while most of us do not know when that will be, it is never to late to Plan to ensure all your affairs are in order when your time comes.
When you die, you leave an estate and if you have Planned, you will have a Will which will set out how you want your estate to be distributed. Before your estate can be distributed, it is likely your executor will need to apply for a grant of probate.
In NSW, the Supreme Court of NSW grants probate. The grant of probate gives your executor the authority to deal with your assets in accordance with your Will.
Our experienced team will work with the executor in a caring and respectful manner to apply for probate and once granted, arrange for the distribution of the estate.
If the deceased did not leave a Will, instead of probate, an application for letters of administration may need to be applied for at the Supreme Court of NSW. Our team can assist with this application.
It is important that the executor is protected from any personal liability for any debts the deceased may have had and also any unpaid tax. We provide advice to the executor regarding these protections.
